What the Special Marriage Act covers

The Special Marriage Act, 1954 is a secular piece of legislation designed to allow civil solemnization of marriages. It covers inter-faith, inter-caste, or secular couples (including Hindus, Muslims, Christians, Sikhs, Buddhists, Jains, or foreign nationals) who wish to marry without changing their religious beliefs or undergoing religious rituals.

Eligibility under the Act

To qualify for solemnization under the Act, the couple must satisfy these conditions:

  • The groom must have completed 21 years of age, and the bride must have completed 18 years of age.
  • Neither party must have a spouse living at the time of the marriage.
  • Both must be of sound mind, capable of giving valid consent.
  • At least one of the parties must have resided in Delhi for at least 30 days immediately preceding the filing of the notice.

The notice and objection process

Once the intended marriage notice is filed online and verified, it is published on the notice board of the SDM office. If any member of the public files an objection regarding their eligibility (e.g. age criteria, previous marriage, prohibited relationships) within the 30-day window, the SDM investigates it. If no objections are raised, the couple can proceed with the solemnization.

Solemnization and the certificate

After the 30-day notice period, the couple visits the SDM office on their appointment date along with 3 witnesses. The bride, groom, and witnesses sign a declaration form in the presence of the Marriage Officer (SDM). The SDM then enters the certificate in the Marriage Certificate Book, making the marriage legally complete.

The public notice concern, addressed honestly

Under Delhi Government regulations, the notice is only displayed on the public notice board of the SDM office. No physical notices or letters are sent to the parents' residential address. The privacy of the couple is respected throughout the process.
